1. Basic information
The operator of this website and the seller is:
- Nikola Kročková, Company No. 04847873 (all prices include taxes and fees)
- Operates under a trade licence
- Collection point: Rose Locale, Klatovy, Plzeňský kraj, Czech Republic
- E-mail: nikolakrockova@icloud.com, Web: www.statekkvet.cz
2. Conclusion of the contract
You can place an order using the forms on this website, by e-mail, by phone, or in person at our place. Your order is a proposal to conclude a contract. The contract is concluded upon our confirmation of the order (by e-mail, phone or in person), or at the latest upon handover of the goods.
For subscriptions, the contract is concluded by payment for the selected package and its content also includes the conditions set out in Section 6 of these terms and conditions.
We present products and prices truthfully and with due care. Because cut flowers are a natural product, the look of an individual bouquet differs from the illustrative photographs.
3. Prices
Prices are quoted in Czech crowns, including all taxes and fees. Delivery is charged according to the chosen delivery method and is always communicated as part of the total price before the order is confirmed.
4. Payment terms
The goods can be paid for as follows:
- by bank transfer on the basis of an invoice — we e-mail the invoice with payment details once the order is confirmed; goods are dispatched after payment is received unless agreed otherwise,
- in cash or via a QR payment code upon collection at our place,
- online by payment card when ordering through the website.
The subscription is always paid in advance for the entire selected period (e.g. for all three bouquets of a three-month subscription at once), before the first delivery takes place. We do not use repeated, continuously charged payments within a single subscription.
5. Delivery
Goods are prepared fresh for the agreed date. You choose the delivery method when ordering:
- collection in person at our place at an agreed time,
- local delivery within our delivery reach (a fee depending on distance; smaller orders subject to individual arrangement),
- delivery via our contracted carrier (PPL) anywhere in the Czech Republic.
Orders with PPL delivery are accepted until [9:00] on the given business day for dispatch the same day. We usually dispatch parcels from Monday to Wednesday so that the goods do not stay with the carrier over the weekend. Delivery takes 1–2 business days from dispatch. Bouquets are packed in special packaging designed for transporting live cut flowers, with the hydration of the stems secured.
6. Flower subscription
The subscription is intended for customers who want regular or individually scheduled deliveries of bouquets on pre-selected dates.
Minimum order and volume. The smallest subscription option we offer includes 3 bouquets. When ordering, the customer chooses the dates of the individual deliveries according to their needs (e.g. anniversaries, birthdays) within the validity of the subscription.
Validity and use. The subscription is valid for [___] from payment / until the ordered number of bouquets has been used up (depending on the chosen option). Unused bouquets expire without compensation once the subscription ends, unless the parties agree otherwise.
Changing a delivery date. The customer may change the requested delivery date at least [3] business days in advance, by e-mail or phone. We try to accommodate later changes according to our operational capacity, but we cannot guarantee them.
Cancellation and refunds. The unused part of the subscription (bouquets not yet dispatched) can be cancelled and the proportional part of the price refunded, based on a written request sent to our contact e-mail. Bouquets already dispatched or being prepared are not refunded.
Recipient not available. If the carrier cannot reach the recipient and the parcel cannot be delivered even after a repeated attempt, we inform the customer. Re-sending the same bouquet on a new date may be charged with additional transport costs.
Changing the delivery address or recipient is possible at any time during the subscription, at least [3] business days before the planned dispatch of the given bouquet.
7. Cut flowers as perishable goods
Cut flowers and floral products are a natural product subject to rapid decay. Their lifespan depends mainly on the species and freshness of the flowers, the season, temperature and care after collection. The approximate lifespan differs by species: hardier flowers last 8–10 days with proper care, an average bouquet usually 5–7 days, and delicate spring species (e.g. tulips) less. Care recommendations can be found on our Fresh flower quality page.
Flowers are supplied fresh and stems are cut on the day of delivery. If some varieties are unavailable in the requested volume, we will offer flowers of equal value, character and colour palette; for more significant substitutions we will always check with you first.
8. Right of withdrawal
Under Section 1837(1)(d) of the Czech Civil Code (Act No. 89/2012 Sb.), a consumer cannot withdraw from a distance contract whose subject matter is the supply of perishable goods. This limitation also applies to supplied cut flowers, floral products and individual deliveries within a subscription.
(Note: we recommend having the exact subsection letter verified by a lawyer against the current wording of the law before publication.)
Where this limitation does not apply, a consumer may withdraw from the contract within 14 days of collection without giving a reason. For goods customised to the customer's wishes (e.g. wedding floristry, made-to-order bouquets), the right of withdrawal under Section 1837(1)(c) of the Civil Code does not apply where the goods are produced or customised after the order; borderline cases are always resolved amicably.
9. Complaints
Please inspect the goods immediately upon collection.
Damage visible on the packaging (mechanical damage to the box, obvious transport damage) should be claimed directly with the carrier and the parcel should not be accepted; please also inform us of the situation by e-mail.
Defects in the goods themselves (damaged or wilted flowers discovered after unpacking, even if the parcel looked undamaged from the outside) will be replaced with a new bouquet or the payment refunded, by agreement with the customer. A complaint must be reported within 24 hours of collection by e-mail with a photograph to nikolakrockova@icloud.com. This 24-hour period concerns only the notification of a defect in perishable goods; the complaint itself is handled within the statutory period (see below).
Defects caused by improper care after collection (e.g. stems not re-cut, direct sunlight, heat exposure, disregard of the care instructions) are not subject to complaint.
The consumer has the right to have a complaint handled at the latest within 30 days of its filing. We agree the remedy (replacement, discount or refund) individually and without unnecessary delay. We issue written confirmations of both the filing and the handling of the complaint.
10. Personal data
Personal data from orders (name, contact details, delivery address, possibly payment details) is processed for the purpose of handling the order, related communication, delivery of the parcel and compliance with statutory obligations (e.g. accounting and tax laws).
The legal basis for processing is the performance of the contract and compliance with legal obligations. Data is passed on to third parties only to the extent necessary to fulfil the order (e.g. to the carrier PPL for the purpose of delivery) and is not provided for other purposes without your consent.
Personal data is kept for the period necessary to process the order and for the period required by law (e.g. accounting and tax regulations).
You have the right of access to your personal data, and the right to have them corrected, erased, their processing restricted and transferred, and the right to object to processing. You can exercise your rights at nikolakrockova@icloud.com. You also have the right to lodge a complaint with the Office for Personal Data Protection (www.uoou.cz).
11. Governing law and effect
These terms and conditions are governed by the law of the Czech Republic, in particular the Civil Code (Act No. 89/2012 Sb.). Consumers may submit a proposal for out-of-court dispute resolution to the Czech Trade Inspection Authority (www.coi.cz), or use the online dispute resolution platform at ec.europa.eu/consumers/odr.
These terms take effect upon publication on the website and may be amended where necessary; the version valid on the date the contract is concluded shall prevail.
